Policy BB-VENDOR-TERMS-2.1 · Version 2.1 · Effective 22 October 2026 · Last updated 22 October 2026
These Vendor Terms & Conditions govern your participation as an independent vendor on the BIGBRANDS marketplace. Your accepted version and acceptance time are recorded during application for both parties' records.
BIGBRANDS operates a marketplace. You are an independent business, not an employee, agent or representative of BIGBRANDS. You control your listings and supplier prices, subject to these terms and marketplace rules. BIGBRANDS adds a markup to your supplier price to determine the customer selling price.
You must complete onboarding, provide accurate identity, business and banking information, and respond to reasonable verification requests before your store can go live. BIGBRANDS may approve, reject or request further information, acting reasonably and subject to applicable law.
You are responsible for accurate product titles, descriptions, images, pricing, stock levels, condition, specifications, availability and any warranty. Listings must be lawful, clear and not misleading, and you must promptly correct errors or unavailable stock.
You must clearly disclose whether every item is New, Used/Second-hand, Refurbished, Resold, Open-box, or another relevant condition. You must not present a refurbished, used, imitation, replica or otherwise non-new item as a new authentic product.
You must comply with applicable laws, including consumer-protection, product-safety, labelling, tax, electronic-commerce and privacy obligations that apply to your products and business. A 'final sale' label cannot deny a customer a statutory remedy.
You must not list or sell counterfeit goods, fake branded goods, pirated goods, stolen goods, products that unlawfully use another party's trademark, or products that infringe copyright, patents or other intellectual-property rights. You must not list any product you are not legally authorised to sell where authorisation is required.
Calling an item 'resold', 'refurbished', 'replica' or similar does not make unlawful goods lawful. You warrant that you have the legal right to sell each product and to use all associated images, trademarks, descriptions and other listing content.
BIGBRANDS may remove or pause a suspicious listing, request proof of authenticity, invoices or supplier documentation, suspend products, suspend your account, or permanently terminate your access where appropriate. We may cooperate with legitimate legal, regulatory and rights-holder requests.
You remain responsible, to the extent permitted by applicable law, for claims, losses, regulatory action and intellectual-property disputes arising from your unlawful products, content or representations. These protections do not purport to exclude any responsibility BIGBRANDS has under applicable law.
Prepare confirmed orders promptly, keep products collection-ready, maintain accurate stock, and respond promptly to order, return and support requests. Repeated non-fulfilment, delays or poor return cooperation may affect account standing.
Customer returns are managed centrally by BIGBRANDS under the Return Policy and Refund & Cancellation Policy. You must provide reasonable information for assessment and accept the financial consequences of a valid return or refund attributable to your item, subject to applicable law and the marketplace process.
You set the original supplier price for your products. BIGBRANDS adds a markup on top of that supplier price to determine the customer selling price. BIGBRANDS earns the markup and does not charge you a commission or deduct a commission from your supplier payout. Your payout is based on your supplier price, subject to the refunds, returns, disputes, chargebacks and adjustments described below. BIGBRANDS does not currently charge a monthly subscription; a future subscription would be introduced only under updated terms or a separately accepted arrangement.
Refunds, returns, disputes, chargebacks and adjustments may affect settlement for the relevant sale. Payout timing is shown or configured in the vendor payout process and may depend on delivery, return, payment and risk checks; it is not a fixed promise in these terms.
You may temporarily close your storefront. Customers cannot place new orders while it is closed. Existing confirmed orders, returns, refunds, disputes, payouts and other outstanding obligations continue. Reopening makes eligible products purchasable again.
You retain ownership of your lawful content and grant BIGBRANDS a non-exclusive licence to display, reproduce and promote it to operate and market the marketplace while it is needed for that purpose. BIGBRANDS may suspend or terminate your account for material breach, prohibited goods, misrepresentation, repeated non-fulfilment, fraud or legal risk.
On closure or termination, you must fulfil confirmed orders or cooperate in refunding them. Amounts properly due for completed, non-refunded sales remain payable, subject to legitimate returns, disputes, chargebacks and set-off.
You are responsible for the safety, legality, accuracy and provenance of your products. To the extent permitted by law, you indemnify BIGBRANDS for claims arising from your products, content, unlawful conduct or breach of these terms. Nothing in this section excludes liability that cannot lawfully be excluded.
We'll always try to resolve a disagreement directly first. This agreement is governed by the laws of South Africa, and any dispute not resolved directly is subject to the jurisdiction of the South African courts.
BIGBRANDS may update these terms by publishing a new version and giving reasonable notice of material changes to active vendors. Changes do not retrospectively remove rights or obligations already accrued.
